Terms of Use and Sale

This is an English translation provided for convenience. The French version is the legally binding one and prevails in case of discrepancy.

These Terms of Use and Sale (the “Terms”) govern access to and use of the Zenvy mobile application (the “Application”), available on iOS and Android, as well as subscriptions to the paid plans offered within the Application.

Important (licence / EULA): use of the Application is also subject to the End User Licence Agreement (EULA) applicable through the App Store (iOS) or Google Play (Android).

1. About the Application

Zenvy is a personalised guided meditation application. The Application uses artificial intelligence to generate content (scripts and/or audio) tailored to the User's emotional state, goals and preferences.

1.1. Publisher

The Application and the getzenvy.app website are published by:

(the “Publisher” or “Linck Labs”).

1.2. Hosting

The getzenvy.app website is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, United States (vercel.com). Application data is hosted by the providers listed in the Privacy Policy.

2. Acceptance

Using the Application implies full and unreserved acceptance of these Terms.
If the User does not accept the Terms, they must stop using the Application.

3. Access to the Application

3.1. Account and authentication

Some features may require an account, created via:

  • email address and password, and/or
  • Sign in with Apple, and/or
  • Google Sign-In.

The User undertakes to provide accurate information and to keep their credentials confidential. Any activity carried out from their account is deemed to have been carried out by them, unless proven otherwise.

3.2. Age requirements

The Application is intended for people aged 15 or over.
For minors, use of the Application is the responsibility of a legal guardian, in accordance with applicable law.

3.3. Availability and technical requirements

The Publisher takes reasonable steps to keep the Application accessible, without guaranteeing continuous availability. Some features require an internet connection.

The Publisher may temporarily suspend access (maintenance, updates, security) without notice where there is a legitimate reason.

4. Services offered

4.1. Meditation generation

The Application lets the User generate personalised meditation sessions, in particular from text and/or voice input and from profile information.

4.2. User profile and preferences

The User may provide information (e.g. first name, age, preferences). This information is used to personalise the experience, in accordance with the Privacy Policy.

4.3. Audio player

The Application may include an audio player (play/pause, speed, ambient sounds, and so on). The exact features may change over time.

4.4. Notifications

The User may enable reminders. Notifications are managed through iOS or Android settings and can be disabled at any time.

5. Subscriptions, trial and billing (App Store / Google Play)

5.1. Subscription products

Zenvy offers auto-renewing subscriptions through the App Store (iOS) and Google Play (Android):

  • Zenvy Pro – Monthly: access to Pro features (duration: 1 month)
  • Zenvy Pro – Yearly: access to Pro features (duration: 1 year)

Pro features include in particular: access to your daily personalised meditation (subject to the offer in force).

Prices, currency and any promotions are shown in the App Store or Google Play purchase interface before confirmation.

5.2. Free trial (where applicable)

A free trial may be offered (e.g. 3 days).
If the User subscribes during the trial period, the subscription becomes payable at the end of the trial, unless cancelled at least 24 hours before the end of the trial period.

5.3. Automatic renewal

The subscription renews automatically at the end of each period, unless the User cancels at least 24 hours before the end of the current period.

5.4. Managing and cancelling

The User can manage or cancel their subscription from:

  • iOS: Apple ID settings → Subscriptions, or the App Store account;
  • Android: the Google Play app → profile icon → Payments and subscriptions → Subscriptions.

5.5. Payment and commission

Payments are processed by Apple (iOS) or Google (Android), acting as resellers of the subscriptions under the terms of their respective platforms. Linck Labs does not collect the User's payment card details for in-app purchases and does not issue the purchase invoice, which is provided by the platform.

5.6. Refunds

Refund requests are handled exclusively by Apple (iOS purchases) or Google (Android purchases), in accordance with their respective refund policies. The Publisher cannot issue a direct refund for purchases made through the App Store or Google Play.

5.7. Right of withdrawal

Under Article L.221-28of the French Consumer Code, the right of withdrawal may not apply to digital content supplied on an intangible medium where performance has begun with the User's agreement.
The User may nonetheless cancel the subscription for future periods.

6. Health, wellbeing and limitations

6.1. Not a substitute for medical advice

Zenvy is not a medical device and provides neither diagnosis nor treatment. Its content is intended for wellbeing and relaxation.

In the event of psychological distress, a crisis, suicidal thoughts or an emergency, the User must immediately contact a healthcare professional or the emergency services. For example: 988 in the United States, 116 123 in the United Kingdom and Ireland, 13 11 14 in Australia, 3114 in France. The Application displays the resource matching your country where one is known.

6.2. Crisis detection (where applicable)

Where the Application includes automated distress-detection mechanisms, these have limitations (false positives and false negatives) and never replace a professional assessment.

7. AI-generated content

7.1. Principle

Some meditations and/or scripts may be generated automatically. The User acknowledges that generated content may contain inaccuracies, clumsy wording or unsuitable phrasing.

7.2. Responsibility for content

The User remains responsible for how they use the content. The Publisher does not warrant that the content is suitable for the User's personal situation.

8. Intellectual property

8.1. The Publisher's rights

The Application, its code, design, graphic elements, distinctive signs (name, logo, trade marks owned by the Publisher) and databases are the exclusive property of Linck Labs and are protected. Any unauthorised reproduction or extraction is prohibited.

8.2. Content made available to the User

Generated content made available to the User is intended for personal and private use. Any redistribution, publication or commercial exploitation without the Publisher's written authorisation is prohibited.

8.3. Ambient sounds and media

The embedded sounds and media are protected and/or licensed. Extracting or reusing them is prohibited.

9. User obligations

The User undertakes to:

  • use the Application in accordance with these Terms and the law;
  • not misuse or disrupt the service (fraud, circumvention, reverse engineering);
  • not submit unlawful, hateful or defamatory content, or content infringing third-party rights;
  • respect intellectual property rights.

10. Liability

10.1. Operation of the service

The Publisher cannot be held liable for interruptions, outages, bugs, incompatibilities or temporary unavailability.

10.2. Limitation

To the extent permitted by law, the Publisher shall not be liable for indirect damage (loss of opportunity, loss of data, loss of business, and so on).

10.3. Third-party services

Some features rely on third-party services (e.g. Apple, Google, cloud providers). The Publisher is not responsible for failures attributable to those services.

12. Changes to the Terms

The Publisher may amend the Terms at any time. The applicable Terms are those published on the date of use.
In the event of a substantial change, the User may be informed through the Application.

13. Termination and account deletion

13.1. Deleting your account

The User may delete their account from within the Application (where the feature is available) or by contacting the Publisher at getzenvyapp@gmail.com. The effects are described in the Privacy Policy.

13.2. Suspension

The Publisher may suspend or delete an account in the event of a breach of these Terms, fraud, a security threat, or a legal obligation.

Important: deleting an account does not automatically cancel an App Store or Google Play subscription. The subscription must be cancelled through iOS settings → Subscriptions, or the Google Play app → Subscriptions.

14. Governing law and disputes

These Terms are governed by French law.
In the event of a dispute, the parties will seek an amicable solution before taking any action. Failing that, the competent courts will be those of the Publisher's registered office, in Paris. Consumers retain the right to bring proceedings before the court of the place where they were domiciled when the contract was concluded or when the harmful event occurred (Article R. 631-3 of the French Consumer Code), and benefit from the mandatory protective rules of their country of residence.

Under Articles L. 611-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge to resolve a dispute amicably, after first sending a written complaint to Linck Labs.
